The Privacy Policy of the searchingsoulmate.com, the platform (hereinafter referred to as “site",”searchingsoulmate” “Booncompanions” or “We” or “Our” or “Us” or “Company”) detailed herein below governs the collection, possession, storage, handling and dealing of personal identifiable information/data and sensitive personal data (hereinafter collectively referred to as “information”) of the User(s) of the site.

Searchingsoulmate is a platform that allows the User(s) to communicate/interact with each other directly through direct messaging without any kind of intervention from Company. This Privacy Policy (“Privacy Policy”) applies to all services provided by Booncompanions and sets out how Booncompanions  may collect, use and disclose information in relation to User(s) of the Platform.

 

By visiting this Platform, providing your information or availing out service, you expressly agree to be bound by the terms and conditions of this Privacy Policy, the Terms of Use and the applicable service terms and conditions, and agree to be governed by the laws of India including but not limited to the laws applicable to data protection and privacy. If you do not agree please do not use or access our Platform.

User(s) may be re-directed, navigate away from the Website to a third party website, you may be subject to alternative terms and conditions of use and privacy policy, as may be specified on such website. In such event, the terms and conditions of use and privacy policy applicable to that website will govern your use of that website, and Booncompanions/searchingsoulmate is in no way responsible for data privacy, protection subjected to that third party sites.

COLLECTION OF INFORMATION

User(s) privacy is important to company and Booncompanions has taken steps to ensure that company do not collect more information from User(s) than is necessary to provide User(s) with Booncompanions’s services and to protect User(s) account. Information including, but not limited to, User(s) name, address, phone number, fax number, email address, gender, date and/or year of birth and User(s) preferences ("Registration Information") may be collected at the time of User(s) registration on the Platform. In this regard, we may also record conversations and archive correspondence between User(s) and the representatives of the site (including the additional information, if any) in relation to the services for quality control or training purposes.

 

Booncompanions records and retains details of User(s) activities on the Platform. Information relating to communication or transactions including, but not limited to, the types and specifications of the goods, pricing and delivery information, any dispute records and any information disclosed in any communication forum provided by us and/or other affiliated companies of Booncompanions  (“Activities Information”) may be collected as and when the communication and / or transactions are conducted through the Platform Booncompanions also gathers and stores the User(s) usage statistics such as IP addresses, pages viewed, User(s) behaviour pattern, number of sessions and unique visitors, browsing activities, browser software operating system etc. for analysis, which helps us to provide improved experience and value added services to you. Once a User(s) registers, the User(s) is no longer anonymous to us and thus all the information provided by you shall be stored, possessed in order to provide you with the requested services and as may be required for compliance with statutory requirements. It is mandatory for User(s) of the Platform to provide certain categories of User(s) Data (as specified at the time of collection). In the event that User(s) do not provide any or sufficient User(s) Data marked as mandatory, company may not be able to complete the registration process or provide such User(s) with Booncompanions’s services. We retain User(s) provided Information for as long as the Information is required for the purpose of providing services to you or where the same is required for any purpose for which the Information can be lawfully processed or retained as required under any statutory enactments or applicable laws of India.

Subject to applicable laws of India, Booncompanions (including our affiliated companies and their designated Service Providers may use User(s) name, phone number, residential address, email address, fax number and other data ("Marketing Data") to provide notices, surveys, alerts, communications and other marketing materials to User(s) relating to services offered by Booncompanions and its affiliated companies,
7. The data shared or submitted to them, collected by them can be used to provide different subscription or packages to the User(s).
8. If User(s) voluntarily submit any User(s) information or other information to the Platform for publication on the Platform through the publishing tools, then User(s) are deemed to have given consent to the publication of such information on the Platform.

 

DISCLOSURE OF INFORMATION

Information we may collect from you may be disclosed and transferred to external service providers who we rely on to provide services to us or to you directly. For instance, information may be shared with:

 

Affiliated companies for better efficiency, more relevancy, innovative business matchmaking and better personalised services.

Booncompanions may share User(s) Data with third parties, including without limitation, banks, financial institutions, credit agencies, or vendors to enable such third parties to offer their or services to such User(s). While company shall endeavour to have in place internal procedures to keep User(s) Data secure from intruders, there is no guarantee that such measures/procedures can eliminate all of the risks of theft, loss or misuse.
5. All voluntary information uploaded by you on the Platform (including without limitation information about your bio, images, remarks, feedbacks etc.) may be made publicly available on the Platform and therefore accessible by any internet User(s). Any voluntary information that User(s) disclose to Booncompanions becomes public information and User(s) relinquishes any proprietary rights (including but not limited to the rights of confidentiality and copyright) in such information. User(s) should exercise caution when deciding to include personal or proprietary information in the voluntary information that User(s) submits to company or uploads on the Platform.

 

Users(s) and third party, external service providers indemnify the company , its affiliates, directors, officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis) and accept that Booncompanions  will not be held liable in any case.

 

SECURITY PRECAUTIONS

We maintain reasonable physical, electronic and procedural safeguards to protect your information. Whenever you access your account information, we offer the use of a secure server. Once your information is in our possession we adhere to our security guidelines to protect it against unauthorized access. However, by using the Platform, the User(s) accept the inherent security implications of data transmission over the internet and the World Wide Web which cannot always be guaranteed as completely secure, and therefore, there would always remain certain inherent risks regarding use of the Platform. User(s) are responsible for ensuring the protection of login and password records for their account.

 

DATA COLLECTION RELATING TO CHILDREN

In line with this belief, we do not knowingly collect or maintain Personally Identifiable Information on our Site from persons under 18 years of age, and no part of our Site is directed to persons under 18 years of age and use of our Platform is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. User(s) have the right to receive your personal data from us in a structured, commonly used and machine-readable form, if you have given us permission to process your data and when the processing was done automatically.

ACCOUNT CLOSURE.

You’ll have great fun on searchingsoulmate.com, but if you feel the need to leave, you can delete your Account at any time. Your Account will be deleted immediately but it may take a little while for Your Content, data to be completely removed from the Website/App. Your profile information will be treated in accordance with our Privacy Policy. If you delete your Account and try to create a new account within this time period using the same credentials, we will re-activate your Account for you.

In case the user forgets or does not to delete the account, the data will be retained by the company for no longer than is required for the purpose for which it was lawfully collected or as otherwise required under another law. Under the data retention provisions set out in various laws, companies are generally required to retain data for eight financial years.

 

APPLICABLE LAW AND JURISDICTION

Each party to the agreement irrevocably agrees that are compliant to all applicable law(s) of India. The parties irrevocably agrees that the court of West Bengal,India shall have exclusive jurisdiction to hear, settle, determine, any breach, disputes, claims arising out of the agreement.

 

GRIEVANCE MECHANISM

The User(s) may submit any grievance with respect to the Platform or the Services, including with respect to any abuse on the Platform and/or any discrepancies or grievances with respect to processing of information to the Grievance Officer 

We will endeavor to resolve your grievances and concerns within timelines as mentioned under applicable laws of India. Booncompanions reserves the right to act upon grievance/complaints received.
